GalleryLogix Beta Test Agreement
This Beta Test Agreement ("Agreement") is entered into between GalleryLogix, LLC ("Company," "we," or "us") and the individual or entity ("Tester" or "you") who registers to access and use the beta version of the GalleryLogix software ("Beta Software"). By accessing or using the Beta Software, you agree to the following terms:
1. Beta Software
You acknowledge that the Beta Software is a pre-release version and is provided for testing, evaluation, and feedback purposes only. The Beta Software may contain bugs, errors, and other problems that could cause system failures, data loss, or other issues.
2. No Warranty
The Beta Software is provided "AS IS" without warranty of any kind, whether express, implied, or statutory. We specifically disclaim all warranties, including but not limited to warranties of merchantability, fitness for a particular purpose, title, and non-infringement.
3. Data Loss
You understand and agree that your use of the Beta Software is at your own risk. The Company is not responsible for any loss of data, corruption, interruption of service, or other damages arising from your use of the Beta Software.
4. Feedback
You agree to provide feedback, bug reports, and suggestions regarding the Beta Software ("Feedback"). We may use this Feedback for any purpose without obligation to you, and you grant us a non-exclusive, worldwide, royalty-free license to use and incorporate your Feedback into our products and services.
5. Confidentiality
Unless otherwise agreed in writing, you agree not to disclose, share, or publicly post information about the Beta Software, including features, bugs, or performance, without our prior consent.
6. Termination
We may terminate your access to the Beta Software at any time without notice. You may stop participating in the beta program at any time by discontinuing use of the Beta Software.
7. Limitation of Liability
To the maximum extent permitted by law, the Company shall not be liable for any damages, including but not limited to loss of profits, loss of data, business interruption, or other direct, indirect, incidental, special, consequential, or punitive damages arising from or related to your participation in the beta program.
8. Governing Law
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, without regard to conflict of laws principles.
9. Entire Agreement
This Agreement constitutes the entire agreement between you and the Company concerning the Beta Software and supersedes all prior or contemporaneous oral or written understandings.
By clicking "I Agree" or by using the Beta Software, you acknowledge that you have read, understood, and agreed to be bound by the terms of this Agreement.
